POOL PROMOTION SPECIAL CONDITIONS

In this document:

Builder means First Home Builders PTY LTD BCN 102621.

Building Contract means a contract with the Builder for the construction of a Dwelling on the Property.

Handover  means  the  handover  of  the  Dwelling  to  the  Buyer  following  completion   of construction of the Dwelling by the Builder.

Pool means a pool of specifications and to a value determined by the Seller in its absolute discretion.

Pool Promotion Design Guidelines means the pool promotion design guidelines included in this Annexure.

Preferred Contractor means BRP WA Factory Pools Perth Pty Ltd & IOCEA Pty Ltd ABN 16 518 834 241 (or such other pool contractor nominated by the Seller).

Promotion Period means the period between 28 January 2020 and 30 April 2020. All other terms used have the same meaning as in Annexure A of this Contract.POOL PROMOTION

Subject to the Buyer complying with the terms of this Annexure, and the Building Plans being designed in accordance with the Pool Promotion Design Guidelines, the Seller will procure the installation of a Pool, on the Property by the Preferred Contractor at the Seller’s cost following Settlement and the Buyer procuring Handover (Pool Promotion).

The Pool will be installed by the Preferred Contractor in accordance with the Pool Promotion Design Guidelines.

 

ELIGIBILITY CRITERIA

The Buyer cannot use the Pool Promotion in conjunction with any other promotions from the Seller.

To be eligible for the Pool Promotion the Buyer must have:

  • entered into this Contract during the Promotion Period;
  • entered into a Building Contract before Settlement; and
  • provided the Seller with a copy of the Building Contract referred to in clause 2.2 and the Building Plans prior to Settlement; and
  • completed Settlement on time and in accordance with the terms and conditions of this

 

  • For clarity, if for any reason whatsoever:
    • Settlement does not occur on time and in accordance with this Contract; or
    • an extension to Settlement is requested,

the Buyer will not be eligible for the Pool Promotion, except if in the absolute discretion of the Seller, the Seller agrees otherwise.

       REDEMPTION CRITERIA

  • The Pool Promotion:
    • is personal to the Buyer as the original purchaser of the Property from the Seller;
    • is not transferable to any other party including any person to whom the Property is sold or transferred; and
    • subject to clause 7, is not exchangeable for cash or any other promotion, property or services.
  • The Buyer must ensure and is solely responsible for ensuring that:
    • the Building Contract and Building Plans are prepared in accordance with this Annexure and the Pool Promotion Design Guidelines; and
    • at the time of Handover, the site for the Pool is clean, free from rubbish, rubble and weed and graded to final levels 40mm below surrounding hard
  • The Buyer must contact the Seller to redeem no later than 12 months following
  • The Buyer acknowledges and agrees that failure to comply with the Buyer’s obligations under clause 2 and 4.3 will result in the Buyer being ineligible to redeem the Pool Promotion and the Buyer fully releases the Seller and will have no Claim or other rights against the Seller as a consequence of the Buyer being ineligible to redeem the Pool Promotion.

 

                  INSTALLATION

  • The Buyer must contact the Seller following Handover of the Dwelling to arrange installation of the
  • The Seller may disclose the Buyer’s name, address, telephone number and, if applicable, email address to the Preferred Contractor for the purpose of arranging installation of the Pool. The Buyer consents to the Preferred Contractor contacting the Buyer
  • If there is any damage to the Dwelling or any retaining wall or fencing on the Property caused by the installation of the Pool, the Preferred Contractor will be liable for any work required to repair the damage and the Buyer fully releases the Seller and will have no Claim or other rights against the Seller as a consequence of any damage caused by the installation of the

         ACCESS

  • The Buyer agrees to provide full and unfettered access to the Preferred Contractor to allow the installation of the Pool to be carried out and
  • The Buyer acknowledges and agrees that failure to comply with the Buyer’s obligations under clause 1 will result in the Buyer being ineligible to redeem the Pool Promotion and the Buyer fully releases the Seller and will have no Claim or other rights against the Seller as a consequence of the Buyer being ineligible to redeem the Pool Promotion.

 

                     SUBSTITUTION OF POOL PROMOTION AT THE SELLER’S DISCRETION

  • If the Buyer has satisfied all of the its obligations in respect of eligibility, redemption and access, but the Seller is unable to provide the Pool Promotion (for some reason not attributable to the Buyer), the Seller may in its absolute discretion:
    • prior to Settlement, provide the Buyer a rebate at Settlement and procure the Builder reduces the price under the Building Contract such that the rebate provided by the Seller at Settlement and the reduction in the price under the Building Contract total an amount commensurate with the value of the supply and installation of the Pool, in substitution for the Pool Promotion; or

 

  • following Settlement, elect to pay the Buyer a cash amount and procure the Builder to (either):
    • reduce the price under the Building Contract; or
    • pay the Buyer a cash amount,

such that the total rebate of the payments or reduction (as applicable) is commensurate with the value of the supply and installation of the Pool in substitution for the Pool Promotion.

  • If clause 1 applies, the Buyer is not entitled to make any Claim against the Seller in respect of the Pool Promotion.

 

                    BUYER ACKNOWLEDGEMENTS

  • The Buyer acknowledges that there may be implications with the Buyer’s loan approval in that the financier may deduct the value of the Pool Promotion from the Purchase Price and value the Property at the reduced
  • The Seller is not responsible for any Claim (including property damage) (however it arises) which the Buyer may suffer or incur arising out of or in connection with the Pool Promotion (including but not limited to a matter arising in connection with clause 1) and the Buyer fully releases the Seller from all Claims.
  • Notwithstanding the Seller’s responsibility under clause 1, the Buyer acknowledges that the Pool Promotion is made available in conjunction with the relevant Builder the Buyer enters into a Building Contract with and that Builder will be making a financial contribution towards the Pool Promotion.

REFERRAL PROGRAM

Do you know of someone looking to build their first home? Send through their details via our website or email sales@firsthomebuilders.com.au, and if they sign up to build, you will receive $3,000. To be eligible to receive the referral fees, the referrer must:

  • Refer a person who enters into a building contract with First Homebuilders Pty Ltd.
  • The referrer must submit the referral by emailing sales@firsthomebuilders.com.au
  • Referred friends must be new clients to First Homebuilders Pty Ltd.
  • Obtain permission from the referee before submitting their details.

The Referee can refer multiple friends — there’s no restriction so refer as many as you like.

The referee must advise First Homebuilders Pty Ltd of the person who referred them at the time of signing a Preliminary Works Agreement. No referral details will be accepted after this point.

The $3,000 referral payment will be paid to the referrer when the referred customer’s home is at practical completion. If the contract is cancelled, this offer becomes null and void.

This referral promotion will run from May 2018.

We pay your rent or mortgage while you build

We’ve introduced our new ‘WE pay your mortgage or rent while you build’ offer, in conjunction with our friends at Surrey Road Finance.

You may not be aware, but over the course of your new home build, periodical payments are required as certain construction milestones are achieved. These costs increase as the loan amount for your new home build is discharged up to its full value, increasing your monthly mortgage repayments accordingly.

These costs are separate to the repayments on your block of land, that you will already be paying off from your date of settlement.

Moreover, both these costs could be in addition to any rent, existing mortgage or housing cost that you are currently paying!

+$10k "FHOG”

 The $10,000 First Home Owners Grant is available in addition to the $40,000 bonus offer, to first time home buyers who meet the Government’s eligibility criteria.

To be eligible for the grant and/or first home owner rate of duty, applicants must satisfy the following criteria:

  • An applicant must be a natural person (i.e. not a company) and be 18 years or over at the time of making application. If you are under 18, you may be able to apply for an exemption from the age requirement.
  • At least one applicant must be an Australian citizen or a permanent resident at the time of making application.
  • Applicants and/or their spouses or de facto partners cannot have:
    • previously received the grant or first home owner rate of duty from any jurisdiction in Australia
    • owned residential property anywhere in Australia before 1 July 2000
    • owned residential property anywhere in Australia on or after 1 July 2000 and occupied that property as a place of residence before 1 July 2004
    • owned residential property anywhere in Australia on or after 1 July 2000 and occupied that property as a place of residence for a continuous period of at least six months that began on or after 1 July 2004.
  • Applicants must occupy the home as their principal place of residence for a continuous period of at least six months commencing within 12 months of settlement if purchasing a home, or within 12 months from the date of completion if building a home.
  • Applicants must hold a relevant interest (ownership) in the land on which the home is situated and must own the home in their own capacity. If they own the home as a trustee, it must be held on trust for a person with a legal disability.  

 New homes The grant is $10,000 or the consideration paid to buy or build the house if less than that amount.

  • For eligible transactions entered into between 1 January and 30 June 2017, an additional $5,000 boost payment may be available.
  • For eligible transactions entered into between 1 July 2000 and 24 September 2013, the grant was $7,000 or the consideration paid if less than that amount.

Established homes

The grant is no longer available for the purchase of established homes.  Purchasers of established homes will still be able to apply for the first home owner rate of duty if certain conditions are met.  See Duties Fact Sheet 'First Home Owner Rate of Duty' for more information.
